The three-day strike, pilots defy government and only make services … – publico

There are only three days to the general strike in the TAP and the conflict starts huffing and puffing. On Tuesday, the pilots, which are vital to ensure that no flights have decided that they will not meet the civil requisition approved by the Government, but rather the minimum services decreed by the arbitral tribunal. The company’s president responded immediately, warning that the failure of the measure shall be liable to disciplinary proceedings.

It was the Civil Aviation Pilots’ Union itself (SPAC) that sent a note to its members, urging them to ensure only the operation that the arbitral tribunal considered mandatory. In other words, far from entirely normal that the Government wanted to achieve with civil requisition approved last Thursday to minimize the impact of downtime 27-30 December between Christmas and the New Year.

In addition to the international airports return trips, the minimum services, defined on Monday, only cover scheduled flights to the Azores, six calls between Lisbon and Funchal in each day of the strike, as well as two daily flights between the capital Maputo and Luanda. Brazil was also included, with some flights to Rio de Janeiro and Sao Paulo.

In the internal memo that the PUBLIC had access, the SPAC considers civil request is a “mere administrative act “and implies” the suspension of the right to strike, constitutionally guaranteed, “adding that the government’s decision” will be contested in court. ” Pilots still write that the executive will have to “comply” with minimal services. “They are the only binding and require the union and TAP”, they say.

Understanding is not, however, shared by all the unions that called the strike. The crew, for example, also went on Tuesday to members, but to clarify that “if civil request is maintained, it must comply with the charges arising from the same.” Despite considering that the measure “is seriously unlawful” and also wish to challenge it, “warn members that” if the court decision were to be unfavorable, incur disciplinary action. “

It was that same message that the president of TAP left on Tuesday to workers in an internal circular that warns that civil requisition must be fulfilled “in all its extension.” On that note, Fernando Pinto also refers to the risks involved who violate the measure. “In case of no show the performance of work or for any other form of non-compliance with civil request by the employee subject to it, will be given immediate initiation of an inquiry process to rigorous clearance of the causes and circumstances of the breach and , where appropriate, the initiation of disciplinary proceedings in terms of the General Labour Law on Civil Servants, as determined in the Ordinance that efectivou civil request, “said the manager.

The 12 unions that called the stoppage gathered on Tuesday, from 20.30, but by the close of this edition was not possible to know whether to take any joint action. The Government, which kept the door open to negotiate, continued looking for a solution to reach an agreement and avoid the damage and conflicts that may arise from the maintenance of these protests.

But the executive also received some comfort the President of the Republic, who decided to promulgate the statute of the privatization of TAP. Cavaco Silva had 40 days to rule on the decision that the government took the Council of Ministers on 13 November.

The sale of the group is precisely the issue that divides unions and the Government, the first since it requires the process to be suspended. But within the trade union platform there are divergent views on the sale of TAP, there some structures that claim only that workers’ rights are guaranteed in the contract documents. These differences have not facilitated the negotiations and threaten to undermine the desconvocação the strike.

It stipulates that the process includes all companies in the TAP group, with sales in the first instance, 66% of capital. But the intention is that the state fully exit the group in the medium term, having been established that the sale of the remaining 34% may occur within two years after the signing of the sales contract.
