The victims of the BES: the impact on the deficiency and the cost to the taxpayers – Money Live

the Católica Lisbon School of Business & Economics has examined in detail the proposal presented by the prime minister to the savers who waited for a solution.

The fine analysis to the document, assessed and outlined the scenarios in question, creating simulations for the future as to the impact on the deficit and costs for taxpayers.

1) SCENARIO WITHOUT IMPACT ON the DEFICIT AND WITHOUT COST TO THE TAXPAYER:

The vehicle incurring the loan with the bank in a particular tax year (sample 2017) in which the State guarantee is triggered, and simultaneously is provided and executed a counter-guarantee of the Resolution Fund in the same fiscal year (2017) of equal value.

2) SCENARIO WITH the IMPACT ON the DEFICIT AND WITHOUT COST TO THE TAXPAYER:

The vehicle incurring the loan with the bank in a particular tax year (sample 2017) in which the State guarantee is triggered and in that the counter-guarantee although provided by the Resolution Fund of equal value is deferred in time beyond the same tax year (example 2022)

3) SCENARIO WITH the IMPACT ON the DEFICIT AND the COST TO THE TAXPAYER:

The vehicle incurring the loan with the bank in a particular tax year in which the State guarantee is triggered and in which no counter-guarantee is there and the final cost, if the vehicle does not recover the credits in question with the third-party debtor in the amount equal to or greater than the value of the mutual.

In conclusion the analysis points out that: for which there is a cost to the taxpayer will not only have to occur a recovery value of the loan less than the value of the Agreement (286M€) over the next few years as still and cumulatively does not exist any counter-guarantee.

Who were the advocates of the process?

The clients, the victims of BES have been advised by a lawyer consultant of Macedo Vitorino & Associates, Luís Miguel Henrique, who has been responsible for mounting a legal solution announced by the prime minister, António Costa.

Luis Miguel Henrique have been dedicated to the dossier, especially from the beginning of 2016 and says to the hard Cash that was "a big challenge being able to contribute to the materialization of the solution, which I consider fair, balanced and equitable, to a problem that had dragged on for more than two years."

The partner of Macedo Vitorino & Associates, João Vitorino says ifr "entire justice to have found a model solution to these victims, and I’m sure to others, that were not covered by this solution, the entities involved will have the same spirit of open and constructive".
