The prosecutor’s office is investigating the so-called VIP contributors list, created by the Tax and Customs Authority (TA). The Department of Investigation and Prosecution (DIAP) in Lisbon opened an inquiry into the case, having at hand the report of the National Data Protection Commission and minutes of parliamentary hearings in the case.
The Attorney General’s Office confirmed the PUBLIC that the case is under investigation, adding that “all the elements obtained” by the prosecution “were sent to Lisbon DIAP.”
The confirmation came on the same day the president of the Budget and Finance Committee, Eduardo Cabrita, announced that the PGR had sent the information to the DIAP Lisbon.
The committee sent the RMP at the end March the minutes of the hearings of former Director-General of AT, António Afonso fights, the former general Deputy José Maria Pires, the Secretary of State for Fiscal Affairs, Paul Nuncio, the president of the Tax Workers Union, Paul Ralha and President of the Association of Professionals of the Tax Inspectorate, Nuno Barroso.
In the possession of the RMP is also the inspection report by the National Data Protection Authority (DPA) the performance of the AT, which confirms the existence of a VIP list.
On Wednesday, it was time to be heard in Parliament the President of the DPA, Filipa Calvão that said he was unaware of the reasons which led to the creation of the list and the criteria for selecting names made public. The lawsuit was filed after go public news realizing that AT employees have accessed the tax records of the Prime Minister without apparent justification, which led to the opening of internal inquiry procedures in tax administration .
The investigation of the DPA confirmed the existence of a list of VIP taxpayers who worked through a warning system to trace who consulted or amended the fiscal data of certain taxpayers. The VIP list, found the DPA, contained the names of Pedro Passos Coelho, Cavaco Silva, Paulo Portas, having been added the name Paul Nuncio, Secretary of State for Fiscal Affairs.
In parliamentary hearing this morning, the head of the National Data Protection Commission testified, based on the performed inspection that the initiative came from the computer security tax. “This initiative [the VIP list], we can safely say, it was up to the computer security field and received an order of the Deputy Director-General to replace the Director-General,” said Filipa Calvão in response to Socialist MEP Isabel Santos.
It is also not know who chose the contributors to the list, the report said, was only composed of four names. “The CN PD did not determine who’s would select the contributors to this effect. Unknown to me, I can not determine this issue, “he said.
response Filipa Calvão arose following a question about an apparent contradiction IT security of the person responsible. It is the former Managing Director of AT Fights Afonso repealing VIP list on February 23, but the next day the head of computer security, José Morujão Oliveira, tells you who is on the list and says wait for more information on taxpayers numbers that would integrate it. Again, the head of the DPA said not knowing what happened.
Another issue that appears in DPA’s report is the fact that only some access to tax data taxpayers who were on the list have been reported for opening an inquiry process. Asked about this selection of employees, which was determined by the inspection report, the president of the DPA said not find an explanation.
Maria Filipa Calvão also criticized the “high degree of informality” in labor relations of senior officials AT, since there was telephone and personal contacts on this matter. As stated in the inspection report, criticized the responsible disposal of electronic mail messages. “It is also strange that there was mails destruction. There are safety rules for information and internal procedures that can not be forgotten and that here have been clearly ignored “he said.
