ASAE filed 108 administrative offense cases on trade – Digital Journal

After a TSF radio news about the two years of the entry into force of the decree-law on restrictive practices of individual trade, ASAE (Food Safety and Economic Authority) detailed Lusa that major violations have been offering for sale or selling at a loss, refusal to sell goods or provide services, not presentation of price tables with the conditions of sale, on request, and not to reduce to writing arrangements on conditions of sale to suppliers.

the ASAE said that of the 108 open cases, 32 are already final decision, all the practice of selling at a loss, but two that refer to the lack of price lists.

the 32 decisions already taken include filing decisions and fine application, some of which were contested in court.

the actions focused on the investigation related to various food and non-food products such as pork, cod, milk, oil, detergent, shampoo, beverages, car accessories, sports and computer articles, books, appliances, among others.

Decree-law No. 166/2013 of 27 December, amended by decree No 220/2015 of 08 October, approved the new legal regime applicable to individual restrictive trade practices.

the new law bases its validity the need to ensure transparency and balance in trade relations and negotiating positions between economic agents, targeting an adjusted competition between companies.

Some changes focused on the notion of selling at a loss, the definition of practices abusive negotiation, the significant increase in penalties for violation of its rules, predicting the possibility of adopting precautionary measures and enforcement of penalty payments and transfer to the authority the responsibility for education and decision of the administrative offense processes that previously competed to the Competition Authority.

in terms of supervision, said ASAE were created 3 Specialized Brigades, one in each Regional Unit, North, Central and South.
