Duarte Lima could reduce his sentence in Homeland process from ten to six years in prison. The Court of Appeal decided this afternoon the appeal brought by the former Social Democratic deputy. It is thus confirmed the conviction of Lima for aggravated fraud and money laundering.
In November 2014, Lima Duarte had been sentenced to 10 years in prison. Already his son, Pedro Lima, was acquitted of the crimes he had been accused.
The ratio also decided that the defendant Vitor Raposo, initially sentenced to six years of effective imprisonment for aggravated fraud crime, now has a sentence of four years in prison.
As for the accused
Francisco Canas was sentenced to three years in prison for the commission of a money laundering offense, one year less than four effective penalty, which was condemned in 2014.
Also according to the President of the Court of Appeal, the accused Carlos Almeida e Paiva has now been convicted in legal cumulo for aggravated fraud and falsification of documents, to two years and six months in prison, but the court suspended the sentence, with the defendant pay compensation of 15,000 euros.
Pedro Miguel Almeida e Paiva was also convicted of the crime of aggravated fraud and forgery in two years and six months respectively , ending the fixed penalty of two years in legal cumulo.
the case dates back to 2007, when Duarte Lima and Victor Raposo created the fund Homeland with money BPN to buy lands in Oeiras. Reportedly, there was built the seat of the Portuguese Institute of Oncology (IPO).
The BPN, which held 15% of the fund, granted a loan of nearly 43 million euros.
Although you can not appeal to the Supreme Court, the defense of Lima Duarte has other possibilities, may intervene before the Constitutional Court, for example, or asking for a clarification of the sentence.
