Government approves amendments to the law of incomes – Business Journal – Portugal

The proposal extends the protection scheme in the commercial lease.

The Government approved this Thursday, September 11, a revision to the law of urban rental.

The aim is to “adjust some aspects of the reform of urban leases, particularly regarding the transition from older contracts to the new regime,” said a statement on the Government in the Council of Ministers.

The amendments relate to the following:

– required information communication held by the landlord for updating the income, “to clarify the tenant of the consequences of absence or lateness of the reply.”

– limiting annual proof of income to tenants to situations where this is requested by the landlord, and in conjunction with the annual settlement of income taxes

– as the requirement proof of payment of stamp on the lease, the special procedure dump tax;.

– and as to whether the tenant claim the tax valuation of the leased

Government also explains the changes promote “an adjustment in the protection of tenants, either by increasing in rental housing, the protection of persons with disabilities, considering the specificities of non rental housing.”

It expanded the scope the protection regime established for the previous 95 contracts, allowing it to be invoked by microenterprises.
